Employer Nomination Scheme (subclass 121/856)

This visa allows Australian employers to sponsor highly skilled workers for a permanent visa to work in Australia. The candidate must be either highly skilled from overseas or a highly skilled temporary resident in Australia. Any secondary applicants included in this visa application can live, work and / or study in Australia.

Eligibility

Employee

The candidate must meet the following eligibility requirements:

Skills must be assessed by relevant skills assessing authority. Have full-time work experience in the occupation for the last three years prior to applying for the visa unless any exemption applies.


or Nominated by an employer for a highly paid senior executive position with a salary of more than $165,000 per annum (excluding superannuation or allowances)


or Engaged in full time work in Australia for last two years on a Subclass 418, 421, 422, 428, 444, 457 or 461 temporary residence visa. The employment must have been in the nominated occupation and the final 12 month period must have been with the nominating employer.


Other Requirements



  • Have an employer willing to sponsor for permanent residency
  • Provide a letter of appointment or contract signed by both the employer and employee
  • Have skills, qualifications and / or experience that match the position requirement.
  • Meet any mandatory licensing, registration or professional membership requirements for the position.
  • have Vocational English language ability
  • Candidate and dependant family members must meet all requirements of Health, Character and Australian Values Statement.
  • Prove that the candidate is to be paid the minimum salary applicable.
  • Under 45 years of age.

Exemption from eligibility requirements

Under some circumstances, exemption from work experience, language or age eligibility requirements may be considered depending on the position, availability / non availability of a suitable candidate, occupation in demand, skills acquired, etc.

Minimum salary level

There are minimum salary levels which must be met. The minimum salary is:

  • $43,440 for all gazetted occupations except Computing Professionals.
  • $59,477 for Computing Professionals.
The minimum salary levels are for gross annual salary and should not include accommodation or rental assistance, board, upkeep, meals, entertainment, incentives, bonuses or commissions, shares or bonus shares, travel, holidays, health care/insurance, vehicles or vehicle allowances, communications packages, living away from home allowance, superannuation contributions or any other non-salary benefits, with the exception of Medicare rebates. Employers may offer any of these benefits if they are above and beyond the minimum salary.
